Privacy Policy and Terms of Use of the Puerto Rico Judicial Branch Website

The purpose of the INTERNET PORTAL OF THE JUDICIAL BRANCH OF PUERTO RICO (hereinafter, Portal or Website), available at www.poderjudicial.pr, is to provide the general public with information about the services and operations of the Courts of the Judicial Branch of the Commonwealth of Puerto Rico (hereinafter, Judicial Branch). By accessing, browsing, or using this Portal, the user expressly accepts the terms of use described herein. If you do not agree to these terms, please refrain from using the Website.

The Judicial Branch may, at any time and without prior notice, revise, replace, or modify this Policy and its Terms of Use and any other information contained in this Portal. It may also add to, restrict, or change the services or programs described in this Website at any time and without prior notice.

This Portal may contain links to other sites of interest or to information or services provided through the websites of other public or private entities or organizations. The Judicial Branch offers these links for the sole purpose of providing information and convenience to its users; therefore, by accessing them, the user acknowledges that they are leaving the Judicial Branch website and that they are subject to the terms of use and privacy policy of the website to which they have been directed. Obligation to make proper use of the Portal and Services

The user agrees to use the Portal and available services in accordance with the applicable laws, this Privacy Policy, and the Terms of Use. The user must not use the Portal for activities contrary to the law, morality, good practices, and public order, or for illicit purposes, or to harm the rights of third parties. The Judicial Branch may deny, revoke, or suspend access, without prior notice, to any user who fails to comply with the terms of use provided herein. 

All intellectual property rights and moral rights of authorship to the Portal, its content, design, domain, logos, and distinctive marks are the property of the Judicial Branch, and access to the Portal and/or its services does not grant the user any assignment, license, or right of any kind over them. The Judicial Branch reserves all property rights that exist or may exist on the Portal, its content, design, domain, logos, and distinctive marks. Any commercial use of the material and information contained in the Portal is strictly prohibited without prior written authorization from the Judicial Branch.

Likewise, although the content is, as previously mentioned, the intellectual property of the Judicial Branch or of third parties and is not to be considered as assigned to the user, the latter may view, copy, and store on their computer hard disk or in any other device, print, or reproduce the material available in this website, solely for their personal or private use or for use within their company or organization, while always noting the Judicial Branch’s ownership of it and that any modification or alteration of its contents is strictly prohibited. This Portal may contain information from other sources; therefore, the consent from such sources must be secured in order to reproduce or make commercial use of such information.

Privacy and Security while Using the Portal

The Judicial Branch will take reasonable measures to protect the security, confidentiality, and integrity of the personal information that it may collect and store from its users. Nevertheless, the Judicial Branch does not guarantee privacy and security in the use of this Portal and its services and, specifically, does not guarantee that unauthorized third parties will not be able to learn the type, conditions, characteristics, and circumstances of the use that the user makes of the Portal and its services The Judicial Branch shall not be liable for damages directly or indirectly related to any unauthorized access of its website and the information stored therein. The Judicial Branch does not guarantee that the content of this Portal is free of viruses or other hidden elements that may cause disturbances in your computer system (software and hardware) or affect the electronic documents and files stored in your computer system, and it shall not be liable for any damage that these may cause. 

For security purposes, the Judicial Branch may use programs and systems to monitor the use of this Portal and to identify attempts to upload, modify, or alter information. All users who access the website expressly agree to such monitoring, and if evidence of possible misuse or criminal activity is found, it may be reported to the appropriate authorities. Any unauthorized use or attempt to upload, change, or modify any information is strictly prohibited and may be punishable under applicable law.

When visiting our website, the Portal may automatically collect and store the following user information:

• The sections visited within the Portal; and

Users’ personal information may also be collected and stored for statistical purposes and to evaluate and improve the Portal’s performance. This information is collected in a way that does not personally identify the user. 

Log Files (Cookies)

This Portal uses log files, or cookies, to store user preferences in order to help customize their online experience. A cookie is a document created by a one-to-one Judicial Branch web server that is saved on the user’s computer hard drive. This file can only be read by a server belonging to the issuing domain. These files cannot be used to run programs or deliver computer viruses on users’ computers; instead, they help users save time by informing the Portal that a particular user has returned to a specific page, thus simplifying the process of logging the personal information provided during a prior visit to the same Portal. When a user returns to the site, the cookies help retrieve the information they provided before so that any previously customized options will be available without having to re-enter them. Users are informed that they have the option of accepting or rejecting the cookie file by changing their computer’s browser settings relative to the Portal’s log file.

Exclusion of Guarantees and Responsibilities

In addition to the foregoing, the Judicial Branch does not guarantee the availability or continued operation of the Portal and the services provided. Nor shall it be liable for any failures, interruptions, unavailability, or inaccessibility of the website or its services. The Judicial Branch will provide advance notice of any interruptions in the Portal’s operation whenever reasonably possible. The Judicial Branch does not guarantee the Portal’s usability nor shall it be liable for the inaccuracy, inadequacy, and/or outdated nature of its content.
